 Re:   Status of the Hendriks Institute  Student Information Bulletin No. 2

             The purpose of this student bulletin is to provide updated information to students who were in attendance at the Hendriks Institute at the time the school closed on Monday, July 7, 2003.  This bulletin will provide you with your rights and options under the Education Law and the Commissioner’s Regulations.  The following options for tuition refunds and or the continuation of your educational programs are as follows:

1.                  Tuition Refund -Students who were enrolled in the Hendriks Institute at the time the school closed are entitled to a refund of the full amount of prepaid tuition.  In order to apply for this refund from the State controlled Tuition Reimbursement Account (TRA), students must complete and submit a BPSS Student Complaint Form if this has not already been done.  This form can be accessed from the website for the Bureau of Proprietary School Supervision (BPSS) at www.highered.nysed.gov/bpss.  Copies of receipts or other proof of paid tuition should be attached to the submitted complaint form.  Due to the volume of student complaints that are expected on this matter, it may take BPSS some additional time to process and evaluate your claim.

2.                  Alternate Education Opportunities – BPSS certainly encourages students to look into other institutions in order to complete your educational goals and objectives.  Listed below are the names of other schools in the Long Island area along with some of the programs that are offered that may suit your interests.  You should contact these institutions for further information.  You can research and evaluate of any of these schools and still apply for a refund as detailed above.

3.                  Teachout – BPSS has approved a teachout plan to be conducted by the New Horizons Computer Learning Center of Long Island, a licensed business school with locations at 900 Merchants Concourse, Westbury, NY (telephone 631-499-7929) and at 6080 Jericho Turnpike, Commack, NY (telephone 631-499-7292).  This teachout option is available to Hendriks students who were enrolled in the Information Technology, Graphics Communication, or Web Development & Programming curriculum.  The teachout option does not apply to students who were in the Multimedia & Digital Video Design program.  The New Horizons teachout plan calls for former Hendriks students to complete their programs at either the Westbury or Commack school locations. Students opting for the teachout will continue with the same curriculum that was previously provided by Hendriks.  New Horizons has indicated that they will keep all Hendriks students together and, if possible, previous licensed teaching staff at Hendriks will be retained by New Horizons to complete the training programs.  

The conditions of a teachout plan are set forth under Section 5006 of the Education law.  One of the conditions of the plan is that students cannot be charged any tuition above that which they already agreed to and paid to the closing school.  In other words, if you already paid your tuition in full under the enrollment agreement to Hendriks, then you can complete your education at New Horizons without any additional tuitions costs.  In addition, you will have a one week period to try the teachout program without any obligation.  You cannot accept the teachout proposal and apply for a refund, however, you can attend the teachout proposal for up to one week as a trial period without waiving your right to a refund.  The option to apply for a refund shall extend to the end of the first week of instruction at the teachout school.  Section 5007(4) of the Education Law.

Sessions to provide additional information and answer your questions will be held at the New Horizons School in Westbury and Commack.  In order to respond adequately to your concerns, the sessions have been organized as follows:

+Wednesday, July 16, 2003 starting at 7:00 PM at the Commack Campus

+Thursday, July 17, 2003 starting at 7:00 PM at the Westbury Campus             

In addition to speaking with representatives from New Horizons, officials from BPSS will be available to further discuss the teachout options and answer your questions on any other issues regarding these matters.
